2. Scope
These Terms govern the use of the website and self-drive rental contracts concluded at a distance through the website between A.C.V. Rent Car S.r.l. (the “Company”) and the customer (the “Customer”). By sending a booking the Customer confirms having read and accepted them. At pick-up the Customer signs the rental contract and the handover report, which complete these Terms.
3. Driver requirements
- minimum age of 18, or the higher age shown on the vehicle page;
- a valid driving licence of the appropriate category, held for at least 12 months or the longer period shown on the vehicle page;
- a valid identity document;
- a credit card in the driver’s name, or another means accepted by the Company, for the security deposit.
The Customer is responsible for complying with the limits for new drivers set by the Italian Highway Code (art. 117). The Company may refuse the handover if the requirements are not met or there are well-founded risks for the vehicle, the Customer or third parties; in that case, if the requirements declared when booking prove untrue, the penalties in section 8 apply.
4. Booking and conclusion of the contract
The Customer chooses the vehicle, pick-up and return date and time and any extras; the website shows the total price before confirmation. During payment the vehicle is reserved for 30 minutes. The contract is concluded when the Company sends the confirmation by email. If payment arrives after the reservation has expired and the vehicle is no longer available, the Company refunds the full amount received.
If online payment is not active, sending the form is a request: the contract is concluded only on the Company’s written confirmation.
5. Prices and payments
Rates are in euros and include VAT unless stated otherwise. They include what is shown on the vehicle page and in the booking summary. A rental day is 24 hours from pick-up, with a 59-minute grace period on return.
Online payments are processed by Stripe (cards, Apple Pay, Google Pay, PayPal and other active methods). The Company does not receive or store full card details. Transactions are protected by strong customer authentication under Directive (EU) 2015/2366 (PSD2). By agreement, payment can also be made via a link sent by email or at our office.
6. Security deposit
At pick-up the Customer provides a security deposit, in the amount shown on the vehicle page, covering damage, theft, fines, tolls, missing fuel and extra costs. The deposit is returned or released within the terms of the rental contract, minus any amounts due.
7. Pick-up, use and return
The vehicle is collected and returned at the office and times stated in the confirmation. Its condition is checked together at pick-up. It must be returned with the same fuel level, in the same condition (normal wear excepted) and free of personal belongings. Lateness beyond the grace period results in an extra day being charged.
The Customer undertakes to: comply with the Highway Code; not sublet, lend or entrust the vehicle to unauthorised drivers; not use it for races, competitions, driving lessons, towing or carrying dangerous goods; not drive under the influence of alcohol or drugs; not leave Italy without written authorisation; look after the vehicle, keys and documents; report breakdowns, accidents or theft immediately; pay fines relating to the rental period.
8. Cancellation and changes
- Free cancellation up to 48 hours before pick-up: full refund;
- between 48 and 24 hours before pick-up: the Company retains 50% of the booking amount;
- within 24 hours of pick-up or no-show: the Company retains the full amount.
Refunds are made to the same payment method within 14 business days. Changes to dates, times or vehicle must be requested at least 24 hours before pick-up, are subject to availability and may change the price. Cancellations and changes can be requested from the “Manage your booking” link received by email, or by writing to info@luxplrentcar.it.
If the Company has to cancel a booking due to force majeure, vehicle unavailability or safety reasons, it offers a vehicle of the same or higher category or a full refund.
9. Right of withdrawal
Under art. 59(1)(n) of the Italian Consumer Code, the right of withdrawal does not apply to car rental contracts with a specific date or period of performance. The cancellation terms in section 8 still apply.
10. Insurance and liability
All vehicles have third-party liability insurance (RCA) as required by law. In the event of an accident, damage or theft the Customer is liable up to the excess stated in the rental contract; without additional cover, for the full damage if caused by wilful misconduct, gross negligence or breach of these Terms. Optional cover (excess reduction, theft and fire, weather events, legal protection) is available on the conditions stated in the contract. The Company quantifies the damage and charges it after notice; the Customer may request an independent assessment at their own expense.
11. Photos and descriptions
Photos and descriptions show the models in the fleet and are illustrative: colour, equipment and accessories may differ slightly. In the event of a substantial difference the Customer may refuse the handover and obtain a refund.
12. Personal data
Customer data is processed under Regulation (EU) 2016/679, as described in the Privacy Policy and Cookie Policy.
13. Complaints and disputes
Complaints: info@luxplrentcar.it or PEC acvrentcarsrl@pec.it. Consumers may use the alternative dispute resolution (ADR) bodies listed by the Italian Ministry of Enterprises and Made in Italy. The European ODR platform has not been active since 20 July 2025 (Regulation (EU) 2024/3228). For disputes with consumers the court of the consumer’s place of residence or domicile has jurisdiction; in other cases the court of Naples. Italian law applies.
14. Final provisions
If a clause is void, the others remain valid. The Company may update these Terms; the version in force at the time of booking applies.
